Prometheus Labor Communications was proud to sponsor Mike Elk’s journalism for the past several years. Mike is very passionate about his work and like us, works hard for the cause of workplace justice.

Over the past few years, Prometheus has donated over $3,000 to Mike when he was a reporter for “In These Times” magazine and as an independent journalist for his own news operation, PayDay Report. We never asked anything in return for our donations, we simply wanted to help out someone who was passionate about telling the story of workers.

Recently, Prometheus Labor Communications agreed to make another donation of $267 to PayDay Report to cover Mike’s AirBnB expenses in Chicago so he could have a place to stay at the People’s Summit conference. Mike never used the money for the AirBnB so we told him to invoice us for “Marketing” because Mike gave Prometheus the opportunity to make a 3 minute presentation at his fundraiser on Friday to a gathering of about 25.

Mike informed us he was very tight on money and needed to cover the rent so in order to help him out, we consented to pay him in Chicago to help him through his hard times. Our standard agreement is to pay invoices within 30 days but we decided to make an exception for Mike due to his circumstances. In Chicago, when Mike sought immediate payment, we offered to transfer the money electronically to his account in order to help him pay his rent. Mike rejected the offer and demanded cash immediately. Despite our reservations about responding to his aggressive demands, we nonetheless contributed $45 in cash at his fundraising event and, another $100 the next day with the cash we had on hand.

However, when he was handed the $100 he became very confrontational at the People’s Summit conference, shouting obscenities and calling us “assholes” and demanded payment for the rest of the cash by midnight because he needed to pay his rent. He told us that unless he received cash by midnight, he would sue us for non-payment. He ranted and yelled for about 10 minutes causing a considerable scene and interrupting the conference. It went on so long and was so loud and aggressive that conference attendees and eventually security asked him to leave. When one bystander suggested he should calm down, Mike berated him as well.

Needless to say, we were quite taken aback by his somewhat less than gracious response for our financial support. We attribute it to Mike’s extreme financial duress. We still think Mike is a very passionate reporter and wish him all the luck but believe it is unwise for us to continue to support Mike’s journalistic endeavors.

We will gladly contribute the remaining balance of $122 to Mr. Elk but he will not be receiving it by midnight tonight. And the seven beers he put on our tab at his fundraiser without quite asking us if it was OK are still on us.

Prohibited Content

The Content displayed and/or processed through the UnionConnect Services shall not contain any of the following types of content:

  1. Content that infringes a third party’s rights (e.g., copyright) according to applicable law;
  2. Excessively profane content;
  3. Hate-related or violent content;
  4. Content advocating racial or ethnic intolerance;
  5. Content intended to advocate or advance computer hacking or cracking;
  6. Gambling;
  7. Other illegal activity, including without limitation illegal export of controlled substances or illegal software;
  8. Drug paraphernalia;
  9. Phishing;
  10. Malicious content;
  11. Other material, products or services that violate or encourage conduct that would violate any criminal laws, any other applicable laws, or any third-party rights.

Prohibited Actions

In addition to (and/or as some examples of) the violations described in the Terms, you may not and may not allow any third party, including your End Users, to:

  1. Generate or facilitate unsolicited commercial email (“spam”);
  2. Send, upload, distribute or disseminate or offer to do the same with respect to any unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, or otherwise objectionable content;
  3. Intentionally distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature;
  4. Conduct or forward pyramid schemes and the like;
  5. Transmit content that may be harmful to minors;
  6. Impersonate another person (via the use of an email address or otherwise) or otherwise misrepresent yourself or the source of any email;
  7. Illegally transmit another’s intellectual property or other proprietary information without such owner’s or licensor’s permission;
  8. Use the Service to violate the legal rights (such as rights of privacy and publicity) of others;
  9. Promote or encourage illegal activity;
  10. Interfere with other users’ enjoyment of the Service;
  11. Sell, trade, resell or otherwise exploit the Service for any unauthorized commercial purpose;
  12. Modify, adapt, translate, or reverse engineer any portion of the Service;
  13. Remove any copyright, trademark or other proprietary rights notices contained in or on the Service;
  14. Reformat or frame any portion of the web pages that are part of the Service’s administration display;
  15. Use the Service in connection with illegal peer-to-peer file sharing;
  16. Display any content on the Service that contains any hate-related or violent content or contains any other material, products or services that violate or encourage conduct that would violate any criminal laws, any other applicable laws, or any third party rights;
  17. Modify the UnionConnect logo or any other UnionConnect or Prometheus Marks; or
  18. Use the Service, or any interfaces provided with the Service, to access any aspect of the UnionConnect Services in a manner that violates the your agreement.

Depending on which version of UnionConnect the Client is using, either the first or the second of the following Privacy Policies applies. If you are uncertain which Privacy Policy applies to you, please contact UnionConnect.

UnionConnect Version One Privacy Policy

Content that the Client transmits using the UnionConnect Services is available to the public, and the Client is not entitled to any privacy with respect to this content. The Client should understand the transmission of content using the UnionConnect Services as similar to the publication of information on a public website.

Information provided by the Client through means other than as content transmitted via the UnionConnect Services may be confidential. Prometheus will make reasonable efforts to safeguard this information and will comply with applicable law.

Prometheus may access, preserve and share the Client’s confidential information in response to a legal request (like a search warrant, court order or subpoena) if Prometheus has a good faith belief that the law requires it to do so. In any such circumstance, Prometheus will first give prompt notice to the Client and allow the Client a reasonable opportunity to respond to said legal request before disclosing confidential information, unless said legal request requires Prometheus make said disclosure without notice to the Client and/or without first offering the Client an opportunity to respond to said request.

Information we receive about the Client may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of the terms or policies of the UnionConnect Services, or otherwise to prevent harm.

UnionConnect Version Two Privacy Policy

Security of your information is important to Prometheus. However, Prometheus does not guarantee the use or operation of any specific security measure, method, protocol, software, or other means in protecting such content. Content that the Client transmits using the UnionConnect Services is protected by an authentication requirement except for such content with respect to which the Client opts out of such protection.

The Client grants Prometheus a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, in providing the UnionConnect Services, any trademarks, certification marks, and service marks owned by the Client.

The Client owns all of the content and information it posts on the UnionConnect Services, and can control how it is shared. In addition:

For content that is covered by intellectual property rights (known as “IP Content”), the Client specifically gives Prometheus the following permission: the Client grants Prometheus a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP Content that it posts on or in connection with the UnionConnect Services (known as the “IP License”). This IP License ends when the Client deletes its IP Content or terminates this Agreement.

When the Client deletes IP Content, it is deleted in a manner similar to emptying the trash or recycle bin on a computer. However, removed content may persist in backup copies, and on mobile devices, for a reasonable period of time. The IP Content may be available to others during the time it remains available on mobile devices, even for some period of time after the Client deletes the IP Content.
